Mogers - A success in Hong Kong 17/12/10
Over a number of years Mogers have been representing UK expats living overseas and have developed a niche specialism in representing those who suffer a relationship breakdown in the UK.
According to statistics at least one third of all marriages will end in divorce. Unfortunately expats fall into the high risk category of individuals whose marriages are likely to fail. Many are often employed in senior positions and therefore have the expectant work and time pressures that can often lead to the neglect of their family. The life of an expat is not for every couple and the strains of moving from location to location, or becoming involved in a different culture, can also place pressures upon relationships. Having successfully represented the husband in the leading reported UK expat case of RP v RP (2006 EWHC 3409 (FAM) Mogers has shown their ability and experience in understanding the specific requirements of an expat client.
Most employers will have had first hand experience of someone who is or has gone through a relationship breakdown and during this time will have noticed that they may have been preoccupied, distracted or emotional. As a consequence a senior employee responsible for making important business decisions is not focused and that is where problems can arise.
London is often referred to as the divorce capital of the world and so why would some UK expats choose to issue in the UK?
Our experience suggests three main reasons, the first being that they choose to use the English legal system because they trust the jurisdiction and believe they will receive a fair outcome.
Secondly, it could be that a spouse or partner has returned to the UK and commenced proceedings, in which case the expat has no choice but to follow and appoint UK lawyers to deal with the proceedings on their behalf.
Finally, different jurisdictions may provide a more favourable outcome. The race to commence proceedings is something worth noting, given that the settlements around the world vary from jurisdiction to jurisdiction, quite often by a considerable margin. It is therefore necessary for anyone suffering a relationship breakdown to take advice immediately to establish, if appropriate, which jurisdiction is most likely to provide the best outcome.

The type of support offered ranges from dealing with daily matters, such as paying accounts and providing money to individuals to arranging care from appropriate professionals and/or help with the decisions of moving from a home to a Nursing or Care Home.
